NELA Terms of Use Policy
This NELA Terms of Use Policy (TUP) sets forth the responsibilities of any individual or organization using the New England Learning Association website (NELA). As used in this TUP, the following terms shall have the following meanings:
“NELA User” means a company or organization that has joined the New England Learning Association as a member, and, as a consequence, “NELA User” shall mean any individual, including without limitation employees, contractors, and other persons enrolled at, associated with, or related to, a NELA User, who accesses or utilizes the NELA website.
1. User Responsibilities.
NELA Users are responsible for reading, understanding, and following the provisions of this TUP. In addition, NELA User is responsible for ensuring compliance with this TUP on the part of their NELA Users. New England Learning Association reserves the right in its sole discretion, and without limiting any other remedies New England Learning Association may have and without incurring any liability, to either temporarily discontinue, or permanently terminate, access to the NELA website for violations of this TUP by an NELA User. Use of NELA services by a NELA User shall constitute acceptance of the terms of this TUP.
2. Unacceptable Terms of Uses
NELA Users may not use NELA:
- in violation of any criminal or civil laws or regulations, whether state or federal
- to gain, or attempt to gain, unauthorized access to any computer or network; for any use that causes interference with or disruption of NELA users and resources, including propagation of computer viruses or other harmful programs
- to cause harm to NELA, or third party equipment, software, or processes used in connection with furnishing the NELA Services
- to intercept communications intended for other persons and/or violate the privacy rights of any person
- to send threatening, abusive, discriminatory, or harassing messages, whether sexual or otherwise
- to access or share indecent, obscene, or otherwise inappropriate materials
- to infringe any intellectual property rights
- to distribute unsolicited bulk electronic mail (”spam”) or any other “junk” mail (unsolicited mail of a business or commercial nature)
- to distribute chain letters
- to engage in Ponzi or pyramid schemes
- to engage in online gambling
- to libel or otherwise defame any person
- or for any other use deemed Terms of by New England Learning Association, provided that New England Learning Association takes commercially reasonable measures to communicate such information to the NELA User.
